Before you gain your Builders licence in WA a clear understanding of Legislation, Acts, Standards and Codes should be a must. Legislation in Australia includes Acts and Regulations. Acts are laws that have been debated and approved by either the State or Federal Parliament. Any change to an Act requires that it go back to parliament, again for debate and approval, which can be a long and costly process.
Each Act will have drafted a corresponding set of Regulations, which support the Act, are consistent with the Act, are generally more prescriptive, and provide more specific detail. While changes to the Act require parliamentary approval, Regulations only require the government department responsible for the Regulations to approve any changes, and as a result are much quicker and less costly to change than its corresponding Act.
Both the Act and its Regulations are legally enforceable.
In addition to the Acts and its Regulations, there may be associated Codes of Practices, Standards and Certifications. These may or may not be enforceable. Codes of Practice are generally not enforceable, and are meant as guides only – guides of good behaviour – which if followed (and “instilled as habits”), will help ensure the Acts and Regulations are abided by.
Registered Building Practitioner
What is a Registered Building Practitioner?
Registration as a building practitioner is for individuals. It allows a person to be a nominated supervisor of a registered building contractor and to use the title ‘registered building practitioner’. A practitioner cannot provide building services directly to another person.
There are several alternative pathways (referred to as “sets”) that can be taken in order to register as a practitioner. One of the pathways requires completion of a course – specifically a CPC50220 Diploma of Building and Construction (Building) , together with seven years’ experience as a supervisor. Another pathway requires membership of certain associations together with several years’ experience.
